On August 26, 1993, the Department of Health and Human Services (HHS) published a Notice of Proposed Rulemaking (NPRM) to implement section 1926 of the Public Health Service (PHS) Act regarding the sale and distribution of tobacco products to individuals under the age of 18. The Secretary requested comments on the NPRM and gave 60 days for individuals to submit their written comments to the Department. The Secretary has considered the comments received during the open comment period and is issuing the final regulation in light of those comments. EFFECTIVE DATE: February 20, 1996. The final rule is developed in accordance with section 1926 of the PHS Act, 42 U.S.C. 300x–26, as amended.
